🚨 TESLA GOES ON TRIAL AS CALIFORNIA ALLEGES BLACK WORKERS FACED RACIAL SLURS, LOWER PAY & BLOCKED OPPORTUNITIES
Tesla is now in court facing one of the biggest racial-discrimination cases involving its Fremont, California factory, and the allegations go far beyond one employee or one ugly workplace incident.
The California Civil Rights Department's case went to trial Monday, September 21, 2026, in Alameda County Superior Court in Oakland. Judge Peter Borkon is hearing the case without a jury, with the trial currently scheduled to continue through October 30.
😳 SO HOW DID WE GET HERE?
California's civil-rights agency sued Tesla in 2022 following an investigation that lasted roughly three years.
The state alleges Black employees at Tesla's Fremont factory were subjected to widespread racial harassment, including repeated racial slurs and racist graffiti. It also alleges Black employees were steered toward more physically demanding jobs, paid less, denied opportunities for advancement and sometimes retaliated against after complaining.
And when I say the allegations are ugly, I mean UGLY.
According to California's case, the N-word was allegedly used frequently inside the factory, including by some supervisors and managers. The state says workers described areas of the factory using terms associated with slavery and alleges racist graffiti appeared in workplace areas. These remain allegations being litigated at trial.
💰 AND THEN THERE'S THE MONEY
This isn't only about what workers allegedly heard.
California alleges Black employees were also treated differently when it came to pay and job opportunities.
The Civil Rights Department says an analysis of Tesla pay data covering June 2018 through June 2024 found Black employees' average monthly compensation was approximately $1,533 lower than white employees' compensation. The state also alleges Black employees were concentrated in harder, lower-level jobs and encountered barriers to promotions.
Those claims are now being tested in court.
⚖️ TESLA DENIES WRONGDOING
And that's important.
Tesla disputes the state's allegations and has maintained that it does not tolerate workplace discrimination. The company has challenged the state's case and argues that allegations involving individual employees should not establish that Tesla maintained a companywide discriminatory system.
So right now, this is not a finding that Tesla violated the law.
This is a trial to determine whether the state can prove its allegations.
👀 AND THIS DIDN'T JUST POP UP YESTERDAY
Tesla's Fremont operation has faced racial-discrimination litigation for years.
One of the most prominent cases involved former Tesla worker Owen Diaz, who accused the company of failing to protect him from severe racial harassment. A federal jury initially awarded Diaz approximately $137 million in 2021, although that award was later dramatically reduced through subsequent court proceedings.
Tesla is also facing a separate racial-harassment lawsuit from the U.S. Equal Employment Opportunity Commission, according to Reuters.
So California's current case lands against a much longer backdrop of disputes over working conditions at Fremont.

Now THIS is the part I'm watching.
A fancy electric car, a futuristic factory and a billionaire CEO don't mean a damn thing if workers walk through those doors and believe they're being treated differently because they're Black.
But this is precisely why we have trials.
California has made some extremely serious allegations.
Tesla says the allegations do not establish systemic discrimination.
Now both sides have to bring the receipts into court, and Judge Borkon gets to decide what the evidence actually proves.
Because whether your car runs on gasoline, electricity or hopes and dreams, the workplace still has to follow employment law.
And if California proves what it's alleging?
That's when this story becomes a whole different conversation.
For now, Tesla is on trial. It has not been found liable in this case.
