🏠 FAKE PAY STUBS FOR AN APARTMENT? FLORIDA'S NEW LAW CAN MAKE THAT A FELONY

Florida renters, you might want to leave Photoshop CLOSED when filling out that apartment application. 😳

Beginning October 1, 2026, Florida's new Fraudulent Entry of Residential Dwellings law takes effect, creating a new criminal offense involving fraudulent information or documents used to obtain possession of residential rental property.

And yes, fake pay stubs are specifically mentioned.

Under the new law, a person can face a third-degree felony if they knowingly and willfully enter into and take possession of a residential dwelling by presenting forged, fictitious or counterfeit documents to the landlord.

Those documents can include:

💵 Pay stubs🏦 Bank statements🪪 Driver's licenses🪪 Identification cards📄 Other forged, fictitious or counterfeit documents

The law also covers materially false written statements about a person's identity on a rental application and situations where someone impersonates another person whose name is being used to obtain the rental.

So this isn't simply, “You wrote the wrong number on your application, now you're going to prison.”

The law requires specific conduct to be done knowingly and willfully, and it applies when that conduct is used to enter into and take possession of the residential property.

But intentionally creating a fake pay stub, submitting counterfeit financial documents or pretending to be somebody else to get into an apartment? Florida has officially made that considerably more serious.

The new offense is classified as a third-degree felony.

The law can have housing consequences too. Fraudulent entry can be treated as noncompliance allowing a landlord to terminate the rental agreement under Florida's landlord-tenant procedures.

The legislation, HB 1293, was approved by Florida lawmakers and signed into law in June 2026. It officially takes effect October 1.

So if your cousin's cousin has been “fixing” pay stubs for $40 and a plate of wings...
