⚖️ JUDGE TELLS TRUMP ADMINISTRATION: YOU CAN’T JUST PUT 75 COUNTRIES ON HOLD!

Baby, somebody bring the gavel because the federal courts have stepped into the immigration fight AGAIN.

And this time, a judge basically told the Trump administration:

“UMMM... THAT AIN’T HOW THIS WORKS.” 😂⚖️

A federal judge in New York has thrown out a Trump administration policy that suspended immigrant-visa processing for people from 75 countries, including Afghanistan, Iran, Russia, Somalia and dozens of others.

Now before everybody starts arguing in the comments, let's get one thing straight:

THIS DOES NOT MEAN THE JUDGE SAID EVERYBODY GETS A VISA.

Nope.

Put the Facebook Law Degree back in the drawer. 😂

The ruling means applicants are supposed to be individually evaluated under existing immigration law, instead of being automatically shut out because their nationality appeared on the administration's 75-country list.

👀 SO WHAT THE HELL HAPPENED?

The State Department announced the policy in January.

The administration's argument was essentially this:

We don't want to issue immigrant visas to people we believe are likely to come to America and eventually depend on public assistance.

The State Department said the suspension was intended to prevent foreign nationals who might become what immigration law calls a “public charge.” 

Okay.

But here's where the judge said:

HOLD THE HELL UP.

U.S. District Judge Jeannette Vargas ruled Friday that the blanket policy conflicted with federal immigration law and went beyond Secretary of State Marco Rubio's legal authority.

Why?

Because Congress gave consular officers the authority to examine individual immigrant-visa applications and determine whether somebody qualifies.

The administration's policy essentially came over the top of those individual decisions and said:

“IF YOU'RE FROM ONE OF THESE 75 COUNTRIES... NOPE.”

And Judge Vargas said you can't do that.

🌎 SEVENTY-FIVE COUNTRIES?!

Baby...

Not seven.

Not fifteen.

SEVENTY. FIVE.

Countries across Africa, the Middle East, Latin America, the Caribbean, South Asia and other regions were affected.

And here's where this became bigger than paperwork.

We're talking about people trying to immigrate legally.

Spouses.

Parents.

Children.

Workers.

People with family members already living in the United States.

Some families had already gone through the process only to have applications stopped or refused under the policy. The lawsuit challenging it included people whose relatives had been denied visas as well as people pursuing employment-based immigration.

THEY WERE TRYING TO COME THROUGH THE FRONT DOOR.

And that's what makes this conversation interesting.

Because every five minutes somebody says:

“Why don't immigrants just come here LEGALLY?”

Okay...

These folks:

WERE APPLYING LEGALLY.

So now what?

⚖️ THE JUDGE DIDN'T OPEN THE BORDER

And this part matters because I already know somebody is typing:

“SO NOW ANYBODY CAN JUST COME HERE?!”

NO.

😂

Nobody said that.

Visa applicants can still be denied.

They still have to meet eligibility requirements.

They still have to go through vetting.

And immigration law already allows officials to consider whether an applicant is likely to become primarily dependent on government assistance.

What the ruling says is that the government can't use this particular blanket nationality-based policy to automatically stop immigrant visas from those 75 countries. 

That's a BIG difference.

Now listen.

America absolutely has the right to control immigration.

We have borders.

We have laws.

We have visa requirements.

And YES, the government should know who the hell is coming into the country.

THAT AIN'T CRAZY.

But here's where you lose me.

You cannot spend years telling people:

“COME HERE THE RIGHT WAY!”

And then when somebody gets in the line, fills out the paperwork, pays the fees, waits on the government and follows the legal process...

turn around and say:

“NOT THAT WAY EITHER.”

😂😂😂

MAKE UP YOUR DAMN MIND!

If somebody doesn't qualify, DENY THEM.

If they fail the vetting, DENY THEM.

If immigration law says they're inadmissible, DENY THEM.

That's what the process is FOR.

But determine that based on the actual person and the law, not simply:

“WHAT COUNTRY YOU FROM?”

Because being born somewhere doesn't automatically tell you whether somebody is going to work, become successful, need assistance, start a business, become a doctor, drive Uber, invent something, pay taxes or sit on somebody's couch eating Cheetos for twelve years.

Hell...

WE GOT PEOPLE BORN RIGHT HERE DOING ALL OF THE ABOVE. 😂

And before somebody turns this into Trump good versus Trump bad, that's not even the legal question the judge decided.

The question was:

DOES THE GOVERNMENT HAVE THE LEGAL AUTHORITY TO DO IT THIS WAY?

Judge Vargas said NO.

The administration may appeal, and immigration policy under Trump continues to face multiple court battles, so don't assume this is necessarily the final chapter. As of the initial reporting, the State Department had not announced whether it would appeal.

But for right now?

That 75-country immigrant-visa suspension just got hit with the federal-court version of:

“RETURN TO SENDER.” 📬😂⚖️
