🚰😳 CLEAN DRINKING WATER IS NOT A CONSTITUTIONAL RIGHT?! BABY... WHAT IS INCLUDED IN THIS COUNTRY?!

Okay, everybody come on in the room because I KNOW I did not read this headline correctly the first time.
A federal appeals court has ruled that clean drinking water is not a right guaranteed by the U.S. Constitution.
I’m sorry.
WATER?!
We’re not talking about free Wi-Fi.We’re not talking about Netflix. We’re not talking about somebody demanding lobster and champagne.
WE. ARE. TALKING. ABOUT. WATER.
The case comes out of Jackson, Mississippi, where four residents sued the city after years of problems with the municipal water system. They argued that officials knew lead was getting into the water and still allowed residents to drink it.
The full Fifth Circuit Court of Appeals ruled 10-5 against the residents’ constitutional claims. The court said the Constitution does not specifically guarantee clean drinking water and rejected their argument that the situation violated their constitutional right to bodily integrity.
Baby...
WHO WAS SUPPOSED TO PUT “DON’T POISON THE WATER” IN THE CONSTITUTION?!
The Founding Fathers?!
They were writing that thing with a FEATHER!
I’m pretty sure they assumed in the year 2026 we'd understand that people need water that doesn't come with a side order of LEAD.
Apparently they needed another amendment:
“Congress shall make no law requiring citizens to drink booty water.”
Because evidently we need EVERYTHING spelled out. 😭
And here's another part that made my eyebrow leave my forehead.
The court also rejected the idea that residents had a constitutional right to truthful information from government officials about the public-health danger. The majority said that not every governmental wrongdoing automatically becomes a constitutional violation.
WAIT.
So if I ask:
“Is this water safe?”
And somebody tells me:
“Absolutely!”
Meanwhile my faucet is pouring out Great Value Flint River Punch...
We're supposed to discuss the constitutional technicalities?!
Baby, I'm thirsty, not studying for the BAR EXAM!
Now, before everybody starts throwing away their faucets, this ruling does NOT mean America suddenly eliminated clean-water laws.
The federal Safe Drinking Water Act still exists, environmental regulations still apply, and people may have other legal options, including state-law claims. This ruling dealt specifically with whether these Jackson residents could pursue this particular claim as a federal constitutional right.
And that's an important distinction.
But from the regular-person section of the courtroom...
THIS STILL SOUNDS CRAZY AS HELL.
Because we can debate constitutional doctrine until somebody turns blue, but if citizens pay taxes and a city supplies their drinking water, expecting that water NOT TO POISON THEM doesn't exactly sound unreasonable.
The court pointed toward other remedies, including lawsuits under other laws and the political process.
The political process?!
Baby, if my water is brown TODAY, I don't want to hear:
“Remember this when you vote in November.”
I NEED A CASE OF DASANI RIGHT NOW. 😂
Jackson's water crisis didn't start yesterday either. Residents have dealt with years of boil-water notices, infrastructure problems and a catastrophic 2022 system failure that left many without reliable running water.
And Jackson is a majority-Black city, which has also fueled a larger fight over whether the community received fair infrastructure investment.
So here's my question:
Should access to safe, clean drinking water actually BE recognized as a constitutional right in America?
Because apparently in 2026 we're debating WATER.
At this rate somebody is going to walk into court next week and tell us:
“Technically... oxygen isn't mentioned either.”
DON'T START. 😭😂
